ABS-CBN Will File a Motion for Reconsideration

Right after the Quezon City Regional Trial Court junked ABS-CBN's P63 million lawsuit against AGB Nielsen Media Research Philippines regarding the tv ratings tampering issue, the kapamilya network announced that it will file a motion for reconsideration.


ABS CBN spokesman Bong Osorio said that the network is determined to continue the fight for a clean and fair TV ratings process.

ABS-CBN is no. 1 in the overall nationwide ratings in 2007 according to AGB Nielsen but in the third quarter to the fourth quarter of the year, GMA-7 is picking up the pace and was able to be no. 1 in the whole Luzon and gradually inching closer and closer to be no. 1 in Metro Cebu and Metro Davao.

In a report by ABS-CBNNews.com, Osorio was quoted as saying:

“The public will not be denied the truth because of a mere technicality. ABS CBN will continue its fight and file a motion for reconsideration. Our case and our moral purpose can only get stronger, as more and more witnesses are coming out to tell the truth about cheating in the ratings. Our witnesses’ courage and passion for truth inspire us and fortify our will to fight for a clean and fair TV ratings process. We promise to continue telling their stories so the public will know how ratings are being manipulated.”

“Cheating is not data error and can never be considered as such. Bribing households equipped with TV meters to change their members’ viewing behavior should be condemned. Acknowledging that it exists and refusing to clean the process is tantamount to condoning and allowing cheating to happen.”

ABS-CBN sued AGB Nielsen last December 14 for releasing overnight tv ratings despite information that some metered households in Vizayas may have been bribed by the “other” network.

ABS-CBN, in their news and public affairs programs on tv and radio, reported that AGB confirmed that GMA 7 is the network behind the bribery of metered households in Bacolod.

Because of the said reports, GMA Network sued ABS-CBN, its executives and talents, for irresponsible journalism and for allegedly accusing GMA of tampering metered households of research firm AGB Nielsen based from a statement of Maya Reforma.

“In reckless disregard of truth, with malice and in bad faith, and with obvious intent to defame and ridicule GMA Network before the public, ABS-CBN distorted, spliced off, and suppressed the accurate and complete statements of Ms. Reforma,” GMA Network said.
