Kris Aquino Declares Nullity of Marriage with James Yap

Kris Aquino announced that her marriage with James Yap was void from the beginning as declared by the court.

The Makati Regional Trial Court has granted Kris Aquino’s petition to nullify her marriage to basketball star James Yap which she filed July of 2010.

In a report by ABS-CBN primetime newscast Bandila, Kris noted that the ground used by the court to officially annul her marriage to Yap is the lack of authority of the officer who solemnized their marriage 5 years ago.

According to Atty. Anna Liza Logan, (a partner of the Marcos Ochoa Serapio and Tan – the law firm retained by Kris), the ground is more applicable to marriage annulment than legal separation.

“Sa legal separation kasi, the marriage bond is not dissolved so they be separated in pact but they cannot marry anyone else. So for a petition for a declaration of nullity or annulment, once the decree is final, they can marry somebody else,” she said.

So Kris and James are officially single again and have the option to marry someone else in the future.

Meanwhile, Kris was awarded custody of Baby James who will still bear the last name of his basketball player dad. James, on the other hand, was granted visitation rights.

Kris and James met in February 6, 2005. He proposed to her on May 4, 2005 and got secretly married in May 28, 2005. The two reprised their civil ceremony wedding at Boy Abunda’s Quezon City residence on July 10, 2005.
